MAP Sweep Desk is a service of Internet Physics, Inc.
Who we are
MAP Sweep Desk is a service of Internet Physics, Inc., a Delaware corporation (Delaware file number 10348328). In these terms, "we", "us" and "our" mean Internet Physics, Inc. acting under the name MAP Sweep Desk, and "you" means the business that receives our free MAP finding or places an order with us.
Our services are for businesses only. By placing an order, you confirm that you act for a business and may bind it.
How MAP Sweep Desk works
We work by email. When you ask for something that these terms and your order confirmation do not answer, we refer it to the officers of Internet Physics, Inc., and the answer reaches you by email from john@mapsweepdesk.com.
The free MAP finding
The free MAP finding costs nothing and commits you to nothing. It is not a trial: it never turns into a paid order, and we never ask for payment details to send it. We prepare at most one free MAP finding for each company, identified by its website domain. We build it only from public sources, as described below, and you may use it as you wish.
The MAP finding covers 20 of your products. For each product it shows each public retailer, marketplace or Google Shopping page we found advertising the product that week, with the advertised price, your published MSRP (manufacturer's suggested retail price), the gap, the link and a dated capture. It also gives a count of retailers and listings below MSRP, and one drafted notice for the largest gap. We write that notice from your published MAP (minimum advertised price) policy text where you publish one, and in neutral wording otherwise, and we mark it as a draft for you to review.
We build it only from public retailer, marketplace, Google Shopping and brand pages, read without any account. We take product names, style numbers and MSRPs from your public website or from retailer pages that show MSRP, and your MAP policy text from your public policy page where there is one. It needs nothing from you. It compares with your public MSRP, not your private MAP list, so it may flag a promotion you approved or a style your policy exempts; the MAP finding says so.
What we do for paying customers
MAP Violation Sweep
One check of up to 1,500 listings against your MAP price list, sent by email with a link to one page of captures. We check the listings of your products on the public retailer, marketplace product and Google Shopping pages on the sweep's coverage list. The coverage list is the list of sites named in your order form. The limit is 1,500 listings, not 1,500 products: if we find more, we check them in the order of your MAP price list until we reach the limit, and we name in the delivery the products we did not reach.
You receive:
- One list, across all those sites, of every listing below MAP: seller, product, advertised price, MAP, gap, link, dated capture, first-seen date, and the seller's public contact details where its page shows them.
- Each violation tracked as a case with a seller history.
- A drafted notice for each violating seller, written from your own policy text and template with the evidence attached.
- Second- and final-notice drafts for repeat violators, following the escalation steps in your policy.
- A re-check of every open violation 7 days later, with the update sent by email.
Your order form states a start date, and no sweep starts before it. We deliver within 2 business days of the latest of the start date, the day the order is made and the day we receive your MAP price list. We reply to any question about a sweep within 1 business day.
Before delivery we check that every listed row has a dated capture showing a price below your MAP; a row that fails is re-captured or dropped. At least nine in ten of the coverage list's pages are captured. Any page not captured is named in the list and retried within 1 business day at no charge.
What you send, once, at purchase: your MAP price list per SKU, your notice template and your escalation steps. If you send no template, we use your public policy text. You send the price list again when a new season's list replaces it. Each sweep is a new order you place; a sweep never repeats on its own.
Retailer Protection Sweep
The top tier, taken instead of a MAP Violation Sweep: a sweep of up to 5,000 listings. It includes the list of listings below MAP, dated captures, the case and seller history, and a drafted notice for every violating seller with second- and final-notice drafts for repeat violators, as described for MAP Violation Sweep. It adds:
- Re-checks of every open violation each day for 7 days, with an alert email each day new ones appear.
- Sellers split into those on and not on your authorized-retailer list.
- A per-retailer report of which authorized retailers are undercut, by whom and for how many days.
Your order form states the coverage list and the delivery date. It also states a start date, and no sweep starts before it. What you send, once, at purchase: your MAP price list covering up to 5,000 listings' products, your authorized-retailer list, and your escalation steps and notice templates. If you send no templates, we use your public policy text. Each sweep is a new order you place.
Daily monitoring
Offered only after a first paid sweep, by its own order. Up to 1,500 listings checked every day on marketplace and non-marketplace sites on the coverage list in your order form. You receive an alert email on each day new below-MAP listings appear, a weekly emailed violation list with drafted notices (up to 5 weekly lists with drafted notices a month), daily re-checks of open violations until fixed, and repeat offenders flagged. Checks are daily at most.
We use the MAP price list, notice template and escalation steps you have already sent. You send a new price list when a new season's list replaces it.
A 1,501st listing is held off the daily check. We then offer you an Extra monitoring block, a Retailer Protection Sweep or a swap of listings; nothing extra is billed without your consent.
Extra monitoring block
An add-on to Daily monitoring, by its own order and only with your consent: an extra block of 500 listings added to the daily check, with the same alerts, weekly lists and drafted notices.
What's not included
- No judgment on whether any practice or policy is lawful, and no writing or revising of the brand's MAP policy
- No sending of notices or contacting of sellers; the brand sends every notice itself
- No takedowns and no unmasking of anonymous sellers
- No counterfeit detection
- No access to the brand's or any marketplace's accounts
- No hourly checks; checks are daily at most
- No check of pages outside the coverage list, or of listings beyond the limit of your order
Prices and billing
All prices are in US dollars and exclude any sales tax that applies by law. We bill only the events this section names; our own errors, retries and failed checks are never billed. We do not ask for payment details before you accept an order, and we start paid work only after you accept it as described in "How orders are made".
MAP Violation Sweep. $350 per MAP Violation Sweep of up to 1,500 listings, billed on delivery. It becomes billable when the violation list and notices are delivered by email, and we invoice it then. A sweep that finds few or no listings below MAP is still billable once it is delivered. Never billed: a sweep that is not delivered, a delivery with fewer than nine in ten of the coverage list's pages captured, the retry of a page not captured, the 7-day re-check, and a re-run under our guarantee.
Retailer Protection Sweep. $3,500 per Retailer Protection Sweep of up to 5,000 listings, billed on delivery. It becomes billable when its violation list and notices are delivered by email, and we invoice it then. The daily re-checks that follow are included. Never billed: a sweep that is not delivered, and our own retries.
Daily monitoring. After a first paid sweep, daily monitoring of up to 1,500 listings with alerts, weekly lists and drafted notices at $1,400 a month, month-to-month, cancel any time. It is billed monthly in advance, and we invoice each month at its start. Never billed: a month that starts after you cancel or while it is paused, and any listing or block you have not agreed to. If you pause during a month you have paid for, the days left in that month are added back when it restarts, before the next charge.
Extra monitoring block. $350 a month for an extra block of 500 listings, billed monthly in advance with Daily monitoring, and only if you have ordered it. It stops when Daily monitoring stops: cancelling or pausing Daily monitoring also cancels or pauses the block. To cancel only the block, say so in your email.
Payment instructions come with the invoice.
Automatic renewal
Daily monitoring renews automatically. Daily monitoring is billed at $1,400 a month every month and renews automatically until you cancel. Your first charge for it is on the day Daily monitoring starts, because it is billed monthly in advance. We start it only after you have replied to its order confirmation with the words "I agree to automatic renewal", separately from accepting the rest of the order, and we keep that reply for at least 3 years, or for 1 year after the plan ends if that is later. When it starts, we email you these terms and how to cancel. We email you at least 30 days before any change to its price, and at least once a year we email you its price, how often you are charged and how to cancel.
To cancel, reply CANCEL to any email from us, or email hello@mapsweepdesk.com with the word CANCEL. No call, form or reason is needed, and we confirm the cancellation by email within one business day. Cancelling stops every later charge at once. Daily monitoring runs to the end of the month you have already paid for, and nothing more is owed.
To pause instead, reply PAUSE. While Daily monitoring is paused we do no work on it and charge nothing for it. It restarts only when you reply RESUME; if you have not replied RESUME within 3 months, it ends without any further charge.
Extra monitoring block renews automatically. Extra monitoring block is billed at $350 a month every month and renews automatically until you cancel. Your first charge for it is on the day the block starts, because it is billed monthly in advance.
Cancelling stops every later charge for the block at once. The block runs to the end of the month you have already paid for, and nothing more is owed.
To pause instead, reply PAUSE. While Extra monitoring block is paused we do no work on it and charge nothing for it. It restarts only when you reply RESUME; if you have not replied RESUME within 3 months, it ends without any further charge.
A sweep does not turn into Daily monitoring. Daily monitoring starts only by its own order and your separate consent.
Cancelling an order
To cancel a MAP Violation Sweep, reply CANCEL to any email from us, or email hello@mapsweepdesk.com with the word CANCEL. If you cancel before it is delivered, we stop the work and nothing is owed. If you cancel after it is delivered, its price is still owed because delivery is the billable event; we stop any re-checks still to come, and our refund rule still applies.
To cancel a Retailer Protection Sweep, reply CANCEL to any email from us, or email hello@mapsweepdesk.com with the word CANCEL. If you cancel before it is delivered, we stop the work and nothing is owed. If you cancel after it is delivered, its price is still owed because delivery is the billable event; we stop any re-checks still to come, and our refund rule still applies.
Guarantees and refunds
Every guarantee we offer, with its conditions, and our refund rule are on our guarantee page at https://mapsweepdesk.com/guarantee. A promise that is not on that page or in your order confirmation is not a guarantee we make.
How orders are made
We send you an order form by email from john@mapsweepdesk.com. It states what we will do, the price and the guarantee that apply. An order is made when you reply to it with your full name, your title, your company's name and the words "I agree"; that reply is your electronic signature on the order form. The order form and these terms are our whole agreement for that order; if they differ, the order form applies.
You can also sign an order for the first paid unit on our website at https://mapsweepdesk.com by submitting the order form there with your full name, your title and your company's name; submitting it is your electronic signature on that order, and the text beside its button says so. The order is made only when we email you an order confirmation from john@mapsweepdesk.com stating what we will do, the dates, the price and the guarantee that apply, and that confirmation is part of our agreement for that order. We send it only once we are ready to start the work; until then no order is made and nothing is owed. A plan that renews automatically is never ordered on the website: it needs your separate email consent as described above.
Your responsibilities
You confirm that the information and files you send us are accurate and that you have the right to give them to us for the work you order. You use what we deliver in compliance with the laws that apply to you.
You send the inputs listed for your order. You review every drafted notice and decide whether to send it; the brand sends every notice itself, and you are responsible for what it says, for your MAP policy and for how you enforce it. A drafted notice is a draft, not a finding that a seller broke any rule or law. You tell us about promotions you have approved and styles your policy exempts, so that you can set those rows aside.
Your material and our work
You keep all rights in the material you send us. Once you have paid for an order, what we deliver under it is yours to use and change. We keep the right to reuse our general methods and know-how, but not your material or your deliverables. How we handle personal information is described in our privacy policy at https://mapsweepdesk.com/privacy.
Confidentiality
We keep the non-public information you send us confidential, use it only to do your work, and share it only with the kinds of service providers our privacy policy names. This does not cover information that is public or that you have told us we may share.
No promise of results
We promise the work described in your order, not a business result such as replies, meetings, sales or revenue, unless a guarantee on our guarantee page says otherwise. Estimates, examples and benchmarks we share are not promises.
We report what public pages show on the date of each capture. We do not promise that a seller raises its price, that a listing comes down, that a retailer stops complaining, or that any sale or retailer relationship is protected.
How the figures on our website are calculated: the dollar gains on our website come from our model of a typical buyer's numbers. Its main inputs are the number of listings checked, the minutes a person would spend on each listing and each notice, the number of violating sellers, and the posted pay of a MAP compliance analyst. Staff time is time freed, not cash saved, unless it avoids a hire. Where a part of the sweep is valued at its own price, that is a price we set, not a saving. Your own results depend on your own numbers.
Limitation of liability
Apart from the work described in your order and the guarantees on our guarantee page, we make no other warranties, express or implied. The free MAP finding is provided as is.
Except for amounts you owe for work delivered, each party's total liability arising out of or relating to these terms or any order is limited to the amount you paid us under the order concerned in the 12 months before the claim arose. Neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data, even if told they were possible. Nothing in these terms limits liability that cannot be limited by law.
Ending an order
Either of us may end an order that is not yet finished, by email, if the other seriously breaks these terms and does not fix it within 15 days of being told. You then pay for the work delivered up to that point, and we refund what you paid for work not delivered.
Changes to these terms
We may change these terms by publishing a new version on this page with a new effective date. An order keeps the terms in force when it was made. For a plan that renews automatically, we email you any change at least 30 days before it applies to you, and you may cancel before then.
Governing law and disputes
These terms and every order are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Before either of us starts a legal claim, we try for 30 days to settle the matter by email. A claim that is not settled is brought only in the state or federal courts located in Delaware, and both of us accept their jurisdiction.
General
You may not transfer an order to someone else without our agreement by email. If a court finds part of these terms unenforceable, the rest still applies. Notices under these terms are given by email: ours come from john@mapsweepdesk.com, and yours go to hello@mapsweepdesk.com.
